The consumption of alcohol and/or drugs can greatly diminish a driver’s ability to operate a motor vehicle and the suspect should have taken that into consideration when he got behind the wheel.

According to Mothers Against Drunk Driving (MADD), each year about 300,000 people are injured in the U.S. due to the negligence of drunk drivers. Drugs other than alcohol play a role in approximately 18 percent of all motor vehicle driver deaths in the nation. The National Institute on Drug Abuse states that the use of any psychoactive drug makes driving unsafe. According to the American Automobile Association (AAA), prescription drugs are the most prevalent of all drugs found in drugged drivers involved in fatal crashes (46.5 percent), and the percentage has continually increased since 2005.

Candice Bond, an experienced DUI accident attorney, was interviewed and provided her thoughts on incidents such as this one.

“Separate from criminal charges, a victim may be entitled to compensation through a civil lawsuit against the responsible party, said Candice Bond, Managing Partner of Bond Legal. “In addition to the diligent work of law enforcement, an attorney can re-interview important witnesses, analyze any surveillance video from the scene of the crash and obtain phone and texting records of the liable party. Serving as an advocate, an attorney can help compassionately guide an injured victim during this difficult time, protecting their legal rights, while ensuring that a driver who takes the wheel under the influence is held accountable for their actions.”

Pending the results of the investigation, the driver of the Corolla injured in this accident may have the right to pursue a personal injury lawsuit. Stefano Formica, Of Counsel with Bond Legal, noted that the stress and worry following a serious injury can be overwhelming, disrupting all aspects of life, including family, work, finances, and overall quality of life.

“It is vital for victims to hire an attorney when filing a personal injury claim, which allows them to negotiate with an insurance company on the behalf of a client,” Formica added. “Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth. However, an attorney will vigorously advocate for their client to ensure that they are treated with respect and compensated fairly.”
