Texas Justices Say Suit Over Defective Ford Explorer Came Late – Bloomberg Law

The Texas Supreme Court dismissed claims against Ford Motor Co. on Friday, saying a driver injured by a potentially defective 2001 Explorer filed the suit a year after the deadline.

The case was brought 16 years after the Explorer was sold, one year beyond the 15 year deadline to bring claims under the state’s repose law, the court said.

Ford’s evidence “easily meets this test,” Chief Justice Nathan Hecht wrote in a unanimous opinion, reversing an appeals court decision for the Explorer owner.
